TERMS & CONDITIONS
- MAKING A BOOKING
To make a booking with Clarity Cars, we require the following information:
- A copy of your full, valid driving licence (drivers must be over the age of 25 and have held a full driving licence for a minimum of 2 years)
- A copy of your passport
- Your full Spanish address during your stay
- A mobile contact telephone number
- Your incoming flight number and arrival time along with your return drop off time.
A 15% non refundable deposit is required at the time of your booking.
The remaining 85% balance must be paid at least 10 days prior to your arrival.
If your booking is made within 10 days of arrival, the full payment will be required at the time of booking.
For your security, we will never ask for your card payment details. All payments are made securely through our online payment system on our payment page.
- CANCELLING A BOOKING
If you need to cancel your booking, you may do so up to 11 days before your arrival date
- Cancellations made 11 days or more before arrival will result in the loss of your 15% non refundable deposit.
- If you have already paid in full, 85% of the total booking cost will be refunded after the deduction of your deposit.
Alternatively, we are happy to move your booking to a new date, without losing any money paid. If the new dates are more expensive, we will inform you and the difference will be payable.
Cancellations made within 10 days of arrival will result in the loss of the full booking amount.
In exceptional circumstances refunds will be considered at the discretion of Clarity Cars and may be issued as credit towards a future booking.

- RENTAL CONTRACT
Full rental details of your rental will be confirmed in the rental agreement.
Rental extensions must be requested at least 48 hours before the contact expiry and are subject to vehicle availability. Additional rental days must be paid before a new contract is issued.
If the rental is terminated early, unused rental days are non-refundable.
Vehicle collection and return at different airports (Alicante or Murcia International) will incur a €35.00 service charge.
- BORDER CROSSING
Vehicles may not be taken outside of mainland Spain with the prior written permission of Clarity Cars.

An unauthorised cross-border use will invalidate insurance cover and the renter will be responsible for all resulting cost.
- OUR VEHICLES
All our vehicles are:
- Regularly serviced and maintained
- Provided in good working condition
- Insured & legal
- Taxed & ITV compliant
If you notice any fault with the vehicle, please inform us immediately so we can resolve it as quickly as possible.
Vehicles are supplied with all the required documents, tools, tyres and accessories. These must be returned in the same condition at the end of the rental period.
5.1 TYRES & WHEELS
Damage to tyres or wheels during the rental period is not covered by the standard insurance/CDW. Any repairs or replacements will be at the renter’s expense.
5.2 VEHICLE CLEANINESS
All vehicles are provided fully cleaned, valeted and sanitised.
We ask that vehicles are returned in a reasonable condition. If excessive cleaning is required, a charge of up to €150.00 may apply for a deep valet.
5.3 NO SMOKING POLICY
Smoking and vaping are not permitted in any of our vehicles.
If there is evidence of smoking or vaping, a cleaning charge between €50.00 and €200.00 may be applied to cover the deep cleaning and air-vent sanitisation.
- VEHICLE USE
- We allow up to 6 drivers on our rental agreement. The vehicle may only be driven by the main driver and any other drivers named and authorised in the rental contract.
- You must advise us of any other drivers and provide a copy of their full, valid driving licence and copy of passport. Any driver must be over the age of TWENTY FIVE and hold a FULL, VALID driving licence for at least TWO YEARS.
- If the vehicle is driven by an unauthorised driver, all insurance protection becomes void and the renter becomes fully liable for all damages, losses and costs arising from any incident.
- The renter must use the rented vehicle according to the following terms of use:
- No modifications may be made to the structure of the rented vehicle; specifically, no roof rack, luggage and/or goods may be attached to the roof.
- The vehicle may not be used to push or tow another vehicle or trailer.
- The vehicle may not be used at sporting events or training sessions of any kind, or car material, accessory or product resistance tests.
- The vehicle and any of its elements or tools may not be transferred, sold, sublet, mortgaged or pledged.
- The vehicle must not be used under the influence of alcohol or drugs.
- The vehicle may not be driven outside Spanish mainland territory.
- The milometer may not be manipulated or unsealed and the lessee must notify any damage thereto. Mileage is measured using the milometer or using road maps should this break.
- The lessee must stop and immobilise the vehicle if they detect any fault or if a warning light indicates any malfunction; they must immediately contact the lessor or its roadside assistance company.
- The rented vehicle may not be used to transport passengers or goods for commercial or industrial purposes if this is not its purpose.
ANY BREACH OF THESE TERMS WILL RESULT IN CLARITY CARS TAKING BACK THE CAR AND ANY MONEY PAID WILL BE LOST.
ANY DAMAGE TO THE VEHICLE AS A RESULT OF BREACH OF THESE TERMS WILL RESULT IN THE INSURANCE COVER BEING INVALID AND ALL COSTS WILL BE THE RESPONSIBILITY OF THE LESSEE.
- INSURANCE AND VEHICLE PROTECTION POLICY
7.1 INSURANCE
All our vehicles are covered by standard Spanish fleet insurance (third party) with AXA and inclusive of breakdown cover.
7.2 COLLISION DAMAGE WAIVER (CDW)
All vehicle rentals include basic level CDW at no additional cost.
CDW limits the renter’s financial liability for accidental damage to, loss of or theft of the rental vehicle during the rental period, provided the vehicle is used in accordance with the rental agreement and terms and conditions.
CDW is not an insurance policy but a contractual limitation of liability.
7.3 EXCESS – RENTER LIABILITY
Under the included CDW, the renter remains responsible for the first €4000.00 of any damage to, loss of or theft of the rental vehicle (the excess amount).
If damage occurs during the rental period, the renter authorises the company to charge the cost of repair, replacement or associated costs up to the excess amount.
7.4 REDUCE YOUR EXCESS
All rentals include CDW with a €4000.00 excess.
Customers can choose to purchase Enhanced CDW for an additional daily fee. This reduces the amount you would need to pay if the vehicle is damaged or stolen during the rental period.

7.5 CAR HIRE EXCESS INSURANCE
Car Hire Excess insurance is designed to reimburse the renter for the excess charged in the event of damage to or theft of the rental vehicle.
Customers are strongly advised to arrange appropriate Car Hire Excess Insurance prior to the start of the rental to cover the excess amount payable under the CDW – this means that you will be not left out of pocket in the event of damage to or theft of the rental vehicle.
Car Hire Excess Insurance also covers you for any additional out of pocket expenses that are not covered under typical insurance for example, loss of keys; use of wrong fuel etc.
7.6 INDEPENDENT CAR HIRE EXCESS INSURANCE PROVIDERS

We do not provide or underwrite Car Hire Excess Insurance.
Any insurance purchased by the renter from a third party provider is a separate contract between the renter and the insurance provider.
We accept no responsibility for the terms, coverage or claims handling of any third party insurance policy.
7.7 NO DEPOSIT WITH EXCESS INSURANCE
Customers who hold valid Car Hire Excess Insurance will not be required to provide a security deposit, subject to verification of the insurance policy at the time of vehicle collection.
This allows customers with appropriate Car Hire Excess Insurance to enjoy a simpler process without a large credit card hold.
If you choose not to have a Car Hire Excess Insurance policy, Clarity Cars will require a €2000.00 security deposit which will be fully refunded within 7 days of the rental vehicles return in the same condition as on collection. There will be a €25.00 administration fee for this service.
7.8 DAMAGE COVERED BY CDW
Subject to the excess amount, CDW covers accidental damage to the rental vehicle including
- Collision Damage
- Vandalism
- Fire Damage
- Theft of the vehicle
7.9 DAMAGE NOT COVERED BY CDW
CDW does not cover damage resulting from negligence or misuse of the vehicle.
Examples include:
- Driving under the influence of alcohol or drugs
- Use by an unauthorised driver
- Off road driving or driving on unsuitable terrain
- Failure to secure the vehicle
- Leaving keys in or near the vehicle
Unless caused by a non fault collision, CDW does not include damage to:
- Tyres and wheels
- Glass and mirrors
- Roof or underbody
- Interior damage
- Lost keys or accessories
- FUEL POLICY
- We work on a like for like fuel basis, so if your vehicle is full on pick up it should be returned with a full tank of fuel.
- We understand that on occasion, you may be running late for your flight and don’t have time to re-fuel. In this event, we ask that you do advise us of this and you will be charged for refueling the vehicle to full, which we will provide a receipt for you.
- On the first occasion we will not charge an admin fee, however if this happens on a regular basis, you will be charged an admin fee of €25.00 on each subsequent occasion.
- Should you use the wrong fuel when refuelling the vehicle:
- STOP refuelling as soon as you become aware
- DO NOT start the vehicle
- ADVISE US IMMEDIATELY
Using the wrong fuel will incur a minimum charge of €300.00 plus the cost of refueling the vehicle.
- DRIVING INFRINGEMENTS AND FINES
- Customers are responsible for the cost of any fines received during the rental period as detailed on your rental agreement.
- In the event of a fine being received we will provide you with a copy of the fine along with a copy of your rental agreement via email.
- Fines normally receive a 50% reduction on prompt payment and we request payment within 48 hours in order to pay this on your behalf to prevent increased charges.
- There is a €25.00 admin charge.
- If payment is not received within 48 hours, we will pass your details to the issuing agency as the named driver in order for them to deal with this directly with you – this could result in additional costs to you in a maximum fine of €1000.00.
